Skagit County DUI Attorney: Changes to the DUI Ignition Interlock License may benefit you!

If you have been charged with a DUI in 2010 and the case is still pending, you may still take advantage of some of the changes to DUI laws in the State of Washington.  One such change is to the Ignition Interlock License.   Introduced in 2009, this license has afforded those with a suspended license as a result of their DUI in Skagit County, DUI in Snohomish County, DUI in Island County or DUI in King County, to continue to drive even though they technically cannot.   One change in this license affects those who decide to do a deferred prosecution in Washington State.  If you are one of those be thankful - if you do things correctly and enter the deferred prosecution prior to the suspension of your license, you will not need an Ignition Interlock License but only the Ignition Interlock Device.  This means no SR 22 insurance!!  And, you will not need the Ignition Interlock for 2 years (like you do currently) but one year.  Big money savings!
More details to come on the many upcoming changes.

Lynnwood DUI Attorney: Target Zero reports 40,205 DUI charges per year

According to Target Zero, a campaign against DUIs, Washington Court data shows 40,205 DUI charges were filed in 2008. There were also 17,804 DUI guilty convictions, 19,562 charges reduced, and 9,512 deferred prosecutions granted. Only 185 cases resulted in acquittals.  The acquittal numbers seem rather low and considering this office accounted for more than half a dozen acquittals at trial, rather surprising.

What is also surprising is the number of deferred prosecutions.  According to this date nearly 1 in four DUI charges resulted in a deferred prosecution.  While I am aware of the value of the deferred prosecution and believe it is a good program, this number (1 in 4) seems very high.  Our office has numbers that are considerably less than 1 in 10 for deferred prosecutions and I suspect most DUI attorneys have similar numbers.  Puzzling number.

Mukilteo DUI Attorney: Target Zero focuses on Snohomish County DUIs, King County DUIs, but not Skagit County DUIs

According to Target Zero, a campaign against DUIs, the following are definitions for Impaired Driving:

Washington State has focused on impaired driving for many years and as a result, there is a great deal of data on impairment. This gives us many ways of looking at the problem. Here is a short list of impairment terms and their definitions as used in this document:

Impairment-related collision. Any driver, motorcycle rider, pedestrian, cyclist, etc with a BAC of .08 or greater and/or a positive result on a drug test. On average for 2006 to 2008, impairment-related collisions accounted for 55% of all traffic fatalities.

Impaired driver. Any driver with a BAC of .08 or greater and/or any driver with a positive result on a drug test. From 2006 to 2008, impaired drivers were involved in 48% of all traffic fatalities.

Alcohol-impaired driver. Any driver with a BAC of .08 or greater. From 2006 to 2008, alcohol impaired drivers were involved in 32% of all traffic fatalities.

Drinking driver. Any driver with a positive BAC or a police report of "had been drinking - impaired," "had been drinking - not impaired" or "had been drinking - impairment unknown." From 2006 through 2008, alcohol impaired drivers were involved in 41% of all traffic fatalities.
