LA PINE, Ore. - A driver faces charges he drove drunk, crashed a car and left his four children alone at the scene of the crash, the Deschutes County Sheriff's Office said.

Davin Wayne Davis, 30, of La Pine (at right) faces charges of Assault II, Driving Under the influence of Intoxicants, Failure to perform the duties of a driver-when a person is injured (Hit and Run), Reckless Endangering another Person (Four Counts), and Reckless Driving.  He is being held on $70,000 bail.

Officers responded to the scene at 8:38 p.m. Monday and found a 1999 Toyota Sienna Minivan upsidedown on the side of the forest road about 6 miles south of Pringle Falls.

The sheriff's office said Davis was speeding down the gravel road when he lost control of the van. The children on board - three girls, ages 13, 10 and 8, and a 2-year-old boy - were able to get out of the van themselves. All four were taken to the hospital, where one was admitted for treatment.

When law enforcement officers from the sheriff's office and USDA Forest Service arrived, Davis fled on foot, the sheriff's office said, leaving his children alone.

He later returned to the scene and was placed under arrest, the sheriff's office said.

Question: Can I be charged with possession after I have been arrested?
Question Detail: I was intoxicated, heavily, according to the police report they found me bleeding on a side walk, when they tried to right me a ticket I ran. I really don’t remember the night, but yesterday I got an email from the wvu saying that I had been charged with possession, on my ticket the only charges are public intoxication, and obstructing an officer. Can they charge me if there was nothing in the report or the ticket?

You can get charged with possession after you are arrested.  Once arrested there is a search of your person incident to arrest and also potentially a search of your vehicle.  If drugs or some illegal object/substance is found during those searches then you can be charged.

Question: Can I get a DUI reduced without an attorney?
Question Detail: I was pulled over for speeding and did have alcohol in my system. After 5 FST's, the officer didn't believe I was capable of driving. Took me to the station and I blew a .08, which is the legal limit. Do I have any chance of getting this DUI reduced solo?

You might be able to have your DUI reduced without an attorney, but the chances are much lower.  If you have an 0.080 then there is a likelihood that you’ll be offered a “reduction.”  However, having your charge reduced, while critically important, is only half of what attorneys can do for you.   If you are offered a reduction, is the reduction fair?  Perhaps a reduction to Negligent Driving First Degree is appropriate but you’re offered Reckless Driving.  Does the offer come with jail, or does it not.  Did you get a decent alcohol evaluation, or not?  Attorneys help with all of these potential issues and make a bumpy ride, smoother.

The Washington Traffic Safety Commission has rolled out a website that allows residents of King, Snohomish and Pierce counties to see when and where law enforcement will be conducting DUI patrols in their communities.

"This is just another tool to get people to make decisions and think twice before they get behind the wheel drunk," said Mark Medalen, communications consultant for the commission. "If you can look online and see that this is going on in your neighborhood and backyard, that will be a deterrent."

The website waTikiLeaks.comwill post a map where citizens can click on the counties to see when and where officers will be looking for impaired drivers. A mobile version is available for smartphones.

From 2004 to 2008, King, Pierce and Snohomish, respectively, were the counties with the highest numbers of impairment-related deaths in Washington — 494 in total, according to the safety commission. The three are the state's most populous counties.
