For decades the State of Washington approved only two BAC machines for DUI cases, the DataMaster and DataMaster CDM.  These relics of the past have had numerous problems and are using technology that predates the modern Personal Computer by decades.  But now, we have a change!  The State has found some money, despite the billion dollar deficit, to fund the purchase of a new, nearly modern BAC machine.  Ladies and Gentlemen I am pleased to announce that the Drager Alcotest 9510 machine has been approved for use in the State of Washington to prove DUIs.  Shall be interesting to see how many errors this machine makes – oh, and the operators too.  Stay tuned.

WAC 448-16-020   Approval of breath test equipment.   (1) Pursuant to RCW 46.61.506, the following instruments are approved for the quantitative measurement of alcohol in a person's breath:

(a) The DataMaster((.));

(b) The DataMaster CDM; and

(c) The Drager Alcotest 9510.

(2) Pursuant to RCW 46.61.506, the following thermometers are approved:

(a) Mercury in glass thermometers with a scale graduated in tenths of a degree measuring a range between 33.5 and 34.5 degrees centigrade.

(b) Digital thermometer system contained within the Guth 2100 wet bath simulator.

Changes in Island County DUI Prosecuting Attorneys

For the last couple of years Island County has maintained two prosecuting attorneys in their District Court in Oak Harbor.  This has resulted in DUI defendants facing a prosecuting attorney who was not as over burdened as other prosecutors (look at Lynnwood prosecuting attorneys or Skagit County prosecuting attorneys as examples).  What this meant is that Island County prosecutors had plenty of time to work a case, argue DUI motions, or even do DUI trials.  However, as of January 3rd one of these two DUI prosecuting attorneys in Island County is moving on leaving only one District Court prosecutor.  This means more work and less time to do it.   How this affects the defense of DUI cases in Island County remains to be seen.

Lynnwood DUI Attorney: Washington State Patrol Press Release regarding "breath test estimates"

Announcement from the Washington State Patrol, Toxicology Laboratory Division regarding breath test estimates.

By the way, did you know that your BAC results are just "estimates" and not actual numbers?  Here is the press release:

December 13, 2010 - The Washington State Patrol, Toxicology Laboratory Division now provides estimates of breath alcohol measurement uncertainty (confidence intervals) with every Quality Assurance Procedure (QAP) performed. This replaces the recent practice of the Division producing estimates of measurement uncertainty for individual breath alcohol results. Person's submitting individual requests for breath alcohol uncertainty (confidence intervals) to the Washington State Patrol will be directed to use the uncertainty tables present on this website.

To access the uncertainty tables, identify the instrument used for your test and then access the records for the calibration completed prior to the test. These are located in the "Q.A. Forms" drop down list accessed through the "DataMaster Search" section. Measurement uncertainty estimates have been included for all instrument QAP's performed since 2009.

The uncertainty sources and equations can be found in the "BTP Public Records Index" section on this site, under the link "Uncertainty". The production of breath alcohol testing-uncertainty estimates should not be construed as having being reviewed or endorsed by any accrediting organization.

D. U. I. APPEARANCE - LOCAL WAIVER

Every person arrested for D.U.I. who is served with a citation or complaint at the time of arrest shall appear in court on the first Tuesday following the date of arrest which is hereby defined as the earliest practicable day for such appearance at such time as shall be written on the citation or complaint.
