If you have been charged with a DUI in the City of Lynnwood and are facing prosecution in the Lynnwood Municipal Court, be very, very aware of their local practice. Specifically, the City of Lynnwood may want to keep your car! Seriously!
The notice that you (or your attorney) may be provided by the prosecutor reads, in part, as follows:
NOTICE NOT TRANSFER, SELL, OR ENCUMBER VEHICLE PENDING DISPOSITION WITH INTENT TO SEIZE AND FORFEIT:
That upon the conviction for a violation of RCW 46.61.502 or RCW 46.61.504, you are further advised that it is the intention of the CITY OF LYNNWOOD to proceed to seize and forfeit said vehicle.
I will save commentary regarding the validity of this “Notice” for another blog, but suffice to say, GET AN ATTORNEY to preserve your rights and your car!
