The Department of Licensing (DOL) hearings are no fun for anyone. You're dealing with biased DOL hearing officers, defense officers, and odds that are worse that Vegas. However, there can be great value to these hearings. In some instances cases have few defenses and/or are destined for trial or motion. The DOL hearing affords the Petitioner and his/her attorney the opportunity to question the officer prior to the officer's contact (and brain washing) with a prosecuting attorney. If your case is tough, destined for trial/motion, or a refusal (so the observations and FSTs have great value) question the officer at the DOL hearing. Because the hearing is conducted under oath you have a very real chance of having the officer testify to something that may benefit your court case. So in summary, despiste the DOL hearings being primarily one sided, do not take them for granded. You may benefit from the experience.
