Island County Washington DUI News: Should Cops charged with DUI be treated differently?

Recently there have been examples of law enforcement officers (State Troopers, Sheriffs, Municipal Police) who have been arrested and charged with DUI.  It is always alarming when this happens as these individuals know more about the dangers of this activity than the general populace and more importantly, are often actively involved in the arrest and prosecution of DUI subjects.  However, when these officers are charged with DUI should the local prosecuting attorney treat them any differently than a normal defendant?  Should the officer charged with a DUI be made an example of?  Barring any extraordinary facts, the only answer is NO.  A prosecutor has a duty to perform justice – to do what is right.  To prosecute an individual and try and make an example of that person, in this case a police officer charged with DUI, seems to ignore the old adage, “justice is blind.”  Every individual should be treated in the same manner as a similarly situated citizen – period!  More on this topic in the days ahead but for now, see the city rules and cases below that demand prosecutors do “justice.” 

Definition:

Justice n. 1) fairness. 2) moral rightness. 3) a scheme or system of law in which every person receives his/her/its due from the system, including all rights, both natural and legal.

Everett DUI News: Woman killed by DUI driver in Everett

Another sad story:

A woman was fatally struck by a suspected drunk driver on Highway 99 on Friday night.  Trooper Keith Leary said the crash occurred in the 13600 block of the highway in front of O'Finnigan's Pub.  A car headed north veered onto the shoulder and hit four or five cars before striking a woman standing in front of the pub.  The 31-year-old Mill Creek woman was pronounced dead at the scene.

Island County Deputy Sheriff Busted for DUI - How will the Sheriff's Office and Island County Prosecuting Attorney deal with this?

As previously reported in other blogs, on August 20, 2010, Whidbey News-Times newspaper reported that Island County Deputy Sheriff Henry Schwab was charged with DUI after he crashed his motor cycle.

It shall indeed be interesting to see how the Sheriff’s Office deals with this Sheriff and the publicity that should come from this.  Further, it shall be interesting to see how the Island County Prosecuting Attorney’s office deals with this.  Will they make an example of Deputy Sheriff Henry Schwab?  Will they simply treat him like everyone else?  Will they do the right thing and remove themselves and bring in a “conflict prosecutor” to prosecute this Deputy Sheriff?  I don’t know but I will definitely be looking into this.

It also raises many other issues.  The truth is that I feel for Deputy Schwab and his family.  Clearly he made a mistake and will pay.  But, humans make mistakes and should be given an opportunity to beg for and eventually receive forgiveness.  While it is true that he broke the law he has sworn to enforce, there may be other issues that he is dealing with.  Check here in future weeks for more updates regarding this particular story.

Island County DUI News: Island County Sheriff's Office has easy decision to help budget - get rid of DUI Deputy

On June 18, 2010, the Whidbey News-Times reported that due to strict budget reductions the Island County Sheriff’s office would, in a worst case scenario, have to cut up to 10 deputy positions.

Why is my King County DUI case taking so long to resolve?

If you have been charged with a DUI case in King County District Court (ie. Redmond, Seattle, Burian, Kent) you may be wondering why it is taking so long to resolve.  You’re not alone.  It is not uncommon for an attorney to request 4 or 5 continuances (request for more time) simply because they have not received an offer (or any correspondence) from the prosecuting attorney.  Why is the prosecuting attorney failing to communicate??

This is becoming more and more common in King County DUI cases and has become a problem.  Although I will not name specific people in the King County Prosecuting Attorney’s office, as I think this is a little unseemly, the fact is that certain people are not doing their job.  There are prosecutors whose specific job is to review cases, determine a reasonable offer, and communicate that offer to the defendant (through their attorney).  Fact is that the prosecutor’s office in King County is failing miserably at this.  While it is understood that budgets are being cut and more is being expected of the prosecutor’s office, it is equally understood that they still must do their job well and efficiently.  And, in the respect of reviewing DUI cases and communicating offers to defense counsel, they are not!  Can’t sugar coat the fact that the King County Prosecuting Attorney’s office is failing the citizens.  They should seriously get their act together – and if not, Judges should act accordingly and harshly.

ISLAND COUNTY DUI SUSPECT GETS HAULED OFF TO JAIL AFTER ATTEMPTING TO ELUDE COP

A 24-year-old Oak Harbor man is accused of stealing a car, leading a state trooper on a brief chase, crashing the car and resisting arrest, all of which occurred after he drank beer and took speed, heroin, Xanax and Percocet, court documents indicate.

Prosecutors charged John Llewellyn in Island County Superior Court Aug. 3 with attempt to elude, theft of a motor vehicle, resisting arrest and DUI.

ISLAND COUNTY SHERIFF'S DEPUTY CRASHES MOTORCYCLE ON CAMANO, ARRESTED FOR DUI

An Island County deputy who crashed a motorcycle while he was off duty last month is under investigation for allegedly driving under the influence.

Undersheriff Kelly Mauck said Deputy Henry Schwab, who was injured in the accident, is on sick leave while an internal investigation is being completed. The sheriff asked the Oak Harbor Police Department to perform the investigation, which could possibly result in disciplinary action.

“The sheriff’s office takes very seriously the investigation of alleged employee misconduct,” he said.

The Washington State Patrol reported that Schwab crashed a 2005 Honda motorcycle on West Camano Road on Camano Island at 3:48 p.m. July 21. The 38-year-old deputy failed to negotiate a turn and left the roadway. Schwab was ejected from the motorcycle.

Schwab was transported to Skagit Valley Hospital for treatment. He was arrested on suspicion of DUI, the state patrol reports.
