Question: What should I do if I am a first time DUI offender?

Question Detail: Here is the deal. I got a DUI after I was pulled over for speeding (11-14 mph over). I did not decline any tests. I failed the breathalyzer downtown. The portable breathalyzers never registered anything. I blew a .11 downtown. I accept that it was a stupid decision and I do not plan on trying to get not guilty. I would like to try to get court supervision for my DUI. Do I need a lawyer for this, or can I just ask the prosecutor myself for court supervision since it is my first offense? I know I was wrong and don't ever plan on going back to jail. I just need advice on whether or not to get a lawyer for this particular case.

Sorry to hear of your situation however, if you are a first time offender, were cooperative, and registered a BAC of 0.11 there is a chance that a DUI conviction may be avoidable, which is a very big deal.  However, you must do things right from the outset.  The first thing is you do need a lawyer.  That is probably not good news but lawyers know the system and it is their job to work the case to where an offer better than DUI is possible.  Simply asking the prosecutor for a reduction will not work in your favor.  They don’t hand out reductions like candy, they fight for their case and their cops.  At the very least talk with a qualified DUI attorney as they can give you good guidance and make you aware of some of the consequences of a DUI charge (such as the DOL hearing and possible license suspension, how to avoid jail, and the alcohol evaluation quagmire.

Question: Can I get a DUI for being in a parked vehicle with the engine on?
Question Detail: I just got a DUI and a driving on a suspended license. This is my first time offense. What should I expect? The car was parked yet running.

If no-one actually sees you drive (and they cannot prove the car had been driven by you) the answer is no.  However, in Washington State there is another crime that look, feels and smells like a DUI.  That crime is Physical Control and has all the nastiness of a DUI.  You can definitely be charged with that.  However, there still may be an issue that can help you – why were you contacted?  The officer needs a lawful reason to contact you, if not, case dismissed.  Good luck.

Question: How do I know if my DUI arrest was legal?
Question Detail: I was pulled over for a DUI and the officer did not say I had violated any traffic laws. He just suspected that I had been drinking, because according to him I was swerving in the lanes. How do I know if this is legal? When is a cop legally allowed to pull you over and charge you for a DUI?
Law enforcement needs probable cause to stop/contact you and also probable cause to arrest you.  In real person terms this means an officer needs a valid reason to stop you.  He cannot just stop you because he suspects you were drinking.  If your driving was erratic the officer needs to articulate the observations – whether he had enough to stop you can be determined by an attorney (and perhaps a Judge later).  To arrest you the officer needs more than “mere suspicion” that you’re driving under the influence.  You really need to have an attorney review your case.

A DUI is really not that much different than any accident that results in injuries.  Therefore if you were injured you can sue for personal damages, including pain and suffering, loss of wages, and so on.

Seattle police have found that drunken-driving arrests were routinely rubber-stamped or falsely certified without approval by a supervisor, prompting one defendant to ask a judge to dismiss his case or suppress the arresting officer's testimony.

The department launched an internal investigation in March after an audit revealed the mishandling of dozens of driving-under-the-influence (DUI) cases.

A sergeant who allegedly permitted the improper screening remains under investigation.

But the department has found that two members of the DUI Unit, Jonathon Huber and Jonathan Young Jr., routinely used the sergeant's signature stamp without having their arrests approved by him as required by policy, according to an internal-investigation report obtained by The Seattle Times.

A third officer, John Velliquette Jr., put written statements in his reports indicating his sergeant had screened his arrests, even though the sergeant had not actually reviewed the cases, the June 22 report said.

Witnesses indicated the sergeant told the officers he had "preapproved" their arrests and offered his signature stamp, according to the report.

The three officers were cleared of misconduct allegations involving honesty and arrest procedures after the department's Office of Professional Accountability (OPA) heard testimony that the practice had been going on for 20 to 25 years and that most law-enforcement agencies do not require DUI arrest screening because most suspects are released after processing.

Witnesses also said the stamp was used to satisfy data requirements and not to deceive.

Question: Can a sober driver be arrested if his passengers are all drinking in the car?
Question Detail: Me and 5 friends are going somewhere an hour away. They all want to drink in the car ride up there, but I don't want to. So I was thinking I would drive, but if we got pulled over and they were drinking open beer cans, while I was COMPLETELY sober, would I be arrested, even if I was the only one doing the right thing?

A driver cannot be arrested, lawfully, for DUI if he/she is sober.  If you are stopped the officer may investigate due to the odor of alcohol in the car, but a good officer, repeat, a good officer, will not arrest you if you are completely sober (translation – absolutely no alcohol in your system).  However, if you are “sober” but have had a drink or two, don’t drink.  It’s simply too risky under this set of facts.

Question: Will I be able to get my DUI dismissed or removed?
Question Detail: I was charged with a DUI this past weekend. I'm 39 and have had only one traffic violation since I was 16. I was told I was pulled over for failing to yield to another traffic stop on the shoulder just prior to my right turn to exit the hiwy. I have never been in this situation before and was unsure of my rights. When asked if I would submit to the voluntary FST, I eventually declined...voluntary sounded fishy, but the officer was very stingy with his information regarding what happends to me if I refuse the test. I found out...I was arrested. Later he informed me that he did not want me to claim my FST results were skewed because I was "under duress" for fear of being arrested. As if I was not under "duress" from the moment his lights came on. At the station I was asked to do the voluntary breathalyzer test. Again, the officer would not tell me what would happen if I refused this test. Luckily, I asked then to speak to a lawyer. She informed me of implied consent (which I believe is the officers responsibility to do so?), since I did not wish to damage myself, only make educated decisions I consented to the test. I blew .067/0.64. My husband is soon to be unemployed again but I want this case to be treated fairly and competently, would a public defender be adequate? What do you think my chances are for dismissal/reduction of charges?

Many questions – many good questions.

First, we always advise that you never participate in the voluntary monkey test, called standardized field sobriety tests.  They never “prove” that you’re sober and they are designed for your failure.  Good job refusing.

Second, the BAC (breath test) at the station is technically voluntary, although there are potentially harsh penalties should you refuse.  These penalties (licensing penalties) have to be read to you in the Implied Consent Warnings. 

In your case it is very good that you provided a breath test at the station.  With your BAC, 0.064/0.067, it is very likely you will not get a DUI.  Even more unlikely you’ll get a DUI if you have an attorney.  Public Defenders do know what they are doing, so you’d be well advised to use them if you cannot afford a private attorney.  However, the question of penalties and the ultimate result is still difficult to answer.  Private attorneys made make this difficult road easier for you to travel, with lighter penalties and even a better result, but either way, a DUI does not look likely.

Reduction – yes; Dismissal – hard to tell.

It must have set a record, but this one South Canterbury family would surely much rather not have, after three of them were booked for drunk-driving on the same night. The saga began about 12.15am when a 15-year-old boy was stopped and arrested for drunk-driving. He blew 529 micrograms per litre of breath, more than three and a half times the youth limit. The teenager was taken to the Timaru police station for processing, where his mother was called to collect him. She was subsequently stopped and arrested for drunk-driving at about 2.14am, after blowing 776 mcg, nearly twice the adult limit of 400.
But it wasn't over there. The woman then rang her partner to come and pick them both up. He was stopped and arrested on North St at about 3am, when he blew 559mcg

A woman in Wisconsin called the emergency to report a drunk driver - which was very civic spirited of her, especially considering that the drunk driver in question was, in fact, her. 49-year-old Mary Strey was driving between Neilsville and Granton in Wisconsin after an evening of over-indulgence when she decided to dial 911 and report herself for driving under the influence.
She began the call with the 911 dispatcher by saying 'Somebody's really drunk driving down Granton Road.' After establishing in which direction the drunk driver was going, the dispatcher asked: 'You behind them?' 'No, I am them,' Strey replied, with commendable honesty.
Police arrived to find Strey slurring her words, swaying from side to side and unable to perform their sobriety tests. Tests later showed she had a blood-alcohol level double the legal limit.

Ohio student James Miller was stopped by police on suspicion of drunk- in Oxford, Ohio, after he was spotted merrily driving the wrong way down a one-way street, while wearing a breathalyzer costume. Suspicions that he may have been drinking were heightened by the fact that there was an open can of Bud Light by the driver's seat. Miller's breathalyzer costume featured a dial with three levels of drunkenness: Boring, Life of the Party, and Sotally Tober.
When confronted, Miller stuffed chewing gum into his mouth, and insisted he hadn't been drinking. Unfortunately, for the fake breathalyzer, a real blood alcohol test showed he had a level of .158, almost twice the legal limit. He was also found to have multiple IDs on him.
Miller was charged with underage drinking, driving under the influence of alcohol and a one-way street violation. He was released to his girlfriend - but not before featuring in an attractive breathalyzer-costume mugshot that will surely guarantee him lasting internet fame.

Ten workers in China pushed their boss's car three miles home after an office party - because they were all too drunk to drive. The group had been enjoying a meal at a restaurant in downtown Changchun, northeast China's Jilin Province, when they realized their predicament. Boss Zhang Fei announced that he was too drunk to drive and suddenly realized nobody had stayed sober enough to drive his car.
Drink-driving was this year listed as a hazardous crime in China and offenders face up to six months in jail and a heavy fine. Zhang did not want to leave his car downtown and it was too late to call out a substitute driver - so vice president Huang Weiyun suggested they all push him home. Huang pointed out that it was only three miles away and that the exercise would do them all good - so all ten quickly agreed and set off with Zhang at the wheel. Passers-by were stunned to see the group, laughing and singing, as they pushed their boss's VW car home through the city streets during the 45 minute journey. Traffic officers said that as long as the car's engine was not running, it would not be classed as drink-driving under Chinese law.

A drunk driver trapped after overturning his car cracked open another can of beer while awaiting rescue. Paul Sneddon, 47, ‘had nothing else to do' but drink, a court heard.  When police asked how much he had drunk, the jobless baker said: ‘Plenty.' He was banned from driving for 10 months and fined a total of $1100 on the charges of driving with excess breath alcohol and careless driving, which he admitted.

A banned driver blew a chance to get his license back when he turned up to take his driving theory test too drunk to even walk. The man, named as Florin I, from Adjud, in Vrancea county, Romania, lost his right to drive when he was caught driving under the influence two years ago.
He came to sit the exam again but said he was too nervous and needed "something to boost his confidence". The exam organizers noticed him having difficulties walking and decided to give him the alcohol test. He was asked to leave the exam room immediately. He was tested with the breathalyzer and it turned out he had 1.11 mg/l alcohol in the exhaled air. The 42-year-old man was told he will be allowed to sit the test again only if he is sober.

Heather Choulos, 32, has been charged with child endangerment and contributing to the delinquency of a minor for letting her underage son drive. Choulos, her boyfriend, Donald Hughes, 29, and her 13-year-old son went to Lo Coco's pizzeria for dinner and after consuming a bottle of wine between the two of them Choulos and Hughes decided they were too intoxicated to drive. The pair has multiple convictions for driving under the influence so they piled into the back seat and decided to pressure Choulos' son into driving her 2008 Land Rover.
The boy, who had never driven before, received no help from the couple in the back because they were too busy making out. The child became scared and frustrated when he realized he was driving the wrong way. Police responded to a stopped vehicle call and when they arrived they found the Land Rover stopped in the middle of Sir Francis Drake Boulevard. The boy apparently had stopped the car and refused to drive any further.

A man who was caught drink-driving in a toy car with a top speed of 4mph has been banned from driving. Paul Hutton, 40, was pulled over by police as he drove an electric Barbie car, which moves slower than a mobility scooter, near his home in Essex. He was given a mandatory three-year ban because he had received another drink-drive ban within the past ten years.
Mr Hutton, who has four children, admitted being a 'complete twit'.
